Beta service

Fomel is an early-access beta. Its output is generated by AI and can be incomplete or wrong; you are responsible for verifying anything before you act on it.

1. Acceptance

By creating an account or using Fomel, you agree to these terms on behalf of yourself and the organization you represent. If you do not agree, do not use the service.

2. The service (beta)

Fomel reads material your organization connects (read only) and returns analysis across three surfaces: Reports, the Assistant, and Decisions. It is an early-access beta and an aid to your own judgement, not a substitute for it. Fomel's output is generated by AI and may be incomplete, out of date, or wrong, and you must verify anything material before acting on it. Fomel does not provide legal, financial, tax, medical, or other professional advice, and you remain solely responsible for your decisions and their outcomes.

3. Subscription, trial, and billing

Fomel offers a single self-serve Standard plan at €300 per month, and a contact-only Enterprise plan offered by separate agreement.

  • New Standard subscriptions include a 7-day free trial. You are not charged during the trial and can cancel any time before it ends and pay nothing.
  • After the trial, Standard is billed monthly in advance and renews automatically each month until cancelled.

You may cancel at any time from billing settings; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law. Prices are in euros; your bank or card network sets any currency conversion. You are responsible for any taxes that apply to you. We may change pricing on reasonable notice, effective at your next renewal.

4. Plan limits and fair use

Each plan carries limits, including the number of decisions per month, connected context volume, seats, and follow-ups. When you reach a limit, Fomel will tell you and point you to an upgrade. We apply reasonable rate limits to protect the service and its other users. Automated scraping, resale of output, or use that imposes a disproportionate load may be throttled or suspended.

5. Acceptable use

You agree not to use Fomel to:

  • Upload or connect data you do not have the right to process.
  • Violate any law, infringe intellectual property, or breach a duty of confidentiality owed to a third party.
  • Attempt to reverse-engineer, probe, or circumvent the security or access controls of the service.
  • Resell, sublicense, or expose the service to parties outside your organization without our written consent.

Fomel does not serve public companies or regulated industries. We may decline or terminate accounts that fall outside this scope.

6. Your data

You retain all rights in the data you connect or upload. You grant us a limited license to process it solely to provide the service, as described in our Privacy Policy and, where applicable, our Data Processing Addendum. You are responsible for the accuracy and lawfulness of the data you provide.

7. Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, update features, or modify the service over time. During closed beta, the service is provided on an as-is basis and features may change without notice.

8. Warranties and disclaimers

Fomel is provided on an "as is" and "as available" basis, especially during beta. Its output is generated by AI models and may be incomplete, inaccurate, or wrong, and must be independently verified before you rely on it. To the fullest extent permitted by law, we disclaim all warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the output is correct or that the service will be uninterrupted or error free.

9. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total aggregate liability arising out of or relating to the service is capped at the greater of the fees you paid to us in the three months preceding the event giving rise to the claim, or one hundred US dollars (US$100).

10. Termination

You may stop using Fomel and delete your account at any time. We may suspend or terminate access for breach of these terms or for conduct that risks the service or other users. On termination, the data handling described in our Privacy Policy applies.

11. Governing law

Fomel is operated by Fomel. These terms are governed by the applicable laws of the United States, where Fomel is currently offered. For any questions about governing law or our legal entity, contact us using the details below.
